Carpay

Privacy Policy

Effective as of February 27, 2026

This Privacy Policy describes how CarPay, Inc. (“CarPay”) handles information about your personal information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, as defined by applicable privacy laws (“Personal Information”) in connection with the software services it provides to automobile dealers (“Dealers”) and to individuals who are borrowers, payers, or account holders of those Dealers (“Consumers”) and our website (the “Site”).

CarPay processes multiple categories of Personal Information for different purposes:

  • Controller Data:  Personal Information that we collect or process for our own business (“Controller Data”).  Controller Data includes contact information provided on the Site, in business interactions for our services, or through other direct marketing activities.
  • Processor Data:  Personal Information that our Dealers ask us to process on their behalf (“Processor Data”). Under applicable law, in certain contexts CarPay is considered the “processor” or “service provider” of Personal Information we receive through our business operations, and our Dealer customer is (or acts on behalf of) the “controller” of the data (i.e., the company with the right to decide how the data is used).  Questions about Processor Data practices should be directed to your applicable Dealer.

PERSONAL INFORMATION WE COLLECT

Information you provide to us

The personal information processed by CarPay may include:

  • Account information, such as first and last name, email address, mailing address, billing address, and phone number.
  • Payment and account information (such as card or bank account numbers) are provided directly by Dealers and securely stored by independent third-party payment processors or vaulting providers. CarPay does not store raw payment card numbers or bank account credentials.
  • Customer Records, including name, postal address, transaction history, telephone number.

Automatic data collection

We, our service providers, and business partners may automatically collect information about your device and interactions with the services, including:

  • Device information, such as IP address, browser type, operating system, device identifiers, language settings, and approximate location information (such as city or state) derived from IP address.
  • Usage and activity information, such as pages viewed, features used, timestamps, navigation paths, and interactions with messages or notifications.
  • Mobile application data, where applicable, including device settings and permissions. Precise geolocation information is collected only where a user has affirmatively enabled location services through a mobile device, and such permissions may be disabled at any time through device settings.

  • Business transfers. We may share personal information in connection with a corporate transaction or potential transaction involving a merger, acquisition, reorganization, sale of assets, financing, or similar transaction involving CarPay or its affiliates. In such cases, personal information may be disclosed to advisors and counterparties subject to customary confidentiality protections.
